1.1. Web Page: The whole design including details and other elements (visual, text, sound, photographs, drawings) provided by a seller who is the exclusively responsible editor, to sell or rent a property, to be displayed on the Internet Site, to be seen by the potential purchaser.
1.2. Seller: A physical person, over 18, who is acting exclusively in a private. non-professional capacity, and are holders of a personal account and have created a web page on the Internet Site. All sellers must be connected to their account to submit a web page. The creation of a first web page must be preceded by an account creation.
1.3. Personal Account: The space which a seller must create and be connected to in the Internet Site in order to manage and see their pages and to subscribe to one or more of the chargeable services.
1.4. J. Preston, Auto-entrepreneur is the business who provides the Internet Site under the number 51915022100017. The business address is a private address, 72150, Courdemanche. If you require the full address, please contact J. Preston via the Contact form on the Internet Site.
1.5. Client Service: The service where the Seller can obtain additional information. This service can be obtained via email by clicking on the Contact link in the Internet Site.
1.8. User: Any visitor having access to the service iVendre via the Internet Site and consulting the service iVendre via any alternative support services
2.1.1.The Terms and Conditions of Sale (TCS) establish contractual conditions when a seller is connected by their personal account and they purchase services on the Internet Site.
3.1. Subscription to free services and payment for payable services by a seller is clear and total acceptance of the TCS.
4. Methods of Subscription to payable services
4.1. General Rules
4.1.1. The subscription to one or more services is exclusively accessible to sellers connected to their personal account in the Internet Site.
4.1.2. A payable service is only available for a single web page and as such is not transferable to the benefit of another web page created.
4.1.3. It is possible to subscribe simultaneously to different web page options.
4.1.4. The price of each web page option depends on the option(s) subscribed to. The pricing table is showing in Section 6.
4.1.5. Web pages are sorted on the service iVendre in chronological order based on the date and time submitted. As a result, all sellers understand that the presence at the top of the list, where the option “Featured Page” is purchased, is temporary.
4.1.6. The payable services are subscribed to at the point of the submission of the web page or the renewal of an expired web page.
4.1.7. The web page subscribed to via a personal account will last for a period of 6 months. Any additional option(s) e.g. “Featured Page” purchased will have the same end date as the subscription period for the web page it relates to.
4.1.8. When the web page is taken down (either by the seller, by J. Preston where there is abusive content, or on the expiry of the period of publication), the payable service ceases. The reinstatement of the web page will not extend the duration of the payable service.
4.1.9. The modification of any item will not prolong the duration of the web page or any options associated with it.
4.1.10. The removal of an account will bring the deletion of all web pages associated with it. The seller understands and accepts that in these circumstances, the payments made will not be refundable or indemnified.
5. Description of the Payable and Non-Payable Services
5.1. Payable Services:
5.1.1. I Create my Web Page: The web page will be created by the seller on the Internet Site. Up to 20 photos may be uploaded and one video link inserted. An email will be sent to the seller to confirm the purchase of the web page and any options and a further email will be sent within two working days, approving the page and advising of publication. An email will also be sent advising of the expiry of the web page and associated options.
5.1.2. Featured Page – the sellers web page will be published and be searchable on the Internet Site.
5.1.3. J. Preston reserves the right to delete any page / item which does not respect the Publication Rules accessible here. Where a publication of a page is refused, the seller will be notified by email.
5.2. Non-payable services:
5.2.1.The seller is permitted to modify all fields in their account and on their web page to render them accurate. All modifications will be modulated by J. Preston.
5.2.2. It is the duty of the seller to verify the content of the account and of the web page. Despite this, J. Preston reserves the right to delete any modified page / item which does not respect the Publication Rules accessible here. Where a modification is refused, the seller will be notified by email.
6.1. The prices applied are those in force at the time of the purchase of the web page and option(s)
7. Payments and Billing
7.1. The purchase of a web page is made by a seller connected to their personal account by:
Their PayPal account accessed through the Internet Site or
By Credit or debit card via PayPal’s guest service, accessed through the Internet Site.
7.2. Payment is demanded after the submission of the web page and any option(s).
7.3. All purchases of payable services will create an invoice accessed through the sellers account. An email will be sent including the invoice number and amount.
8. Refunds and Retraction
8.1.1. Payable services are not refundable
8.1.2. If the publication of the page has been refused by J. Preston, due to it not conforming to the Publication Rules accessible here, subject to clause 8.1.3 below, the amount paid for the web page during the submission will be refunded and an email will be sent to the seller advising them that the web page has been refused by J. Preston and that it will not be published.
8.1.3. If J. Preston is forced to delete the web page because of its non-conformity to the Publication Rules accessible here because the content is confirmed as being abusive, J. Preston will not refund the seller the amount paid during the submission or modification of the web page and an email will be sent to the seller advising them that the web page creation has been refused by J. Preston, advising them of the reasons and that the web page will be withdrawn from publication.
8.1.4. If the modification of the page has been refused by J. Preston, due to it not conforming to the Publication Rules accessible here, the amount paid for the web page during the submission will not be refunded and an email will be sent to the seller advising them that the web page modification has been refused by J. Preston, advising them of the reasons, and that the web page will be withdrawn from publication.
8.1.5. The seller understands and accepts that, where a personal account has had to be deleted and, as a result, all the attached web pages, this will not give the right to a refund or indemnity.
8.2.1. By application of the article L121-21 of the Code de la Consommation, the seller has 14 days to withdraw his web page. However, by paying for the web page, the seller accepts that J. Preston has begun to process the web page and therefore the right to withdrawal is expressly renounced.
9. Responsibility and Force Majeure
9.1. J. Preston has no responsibility for the poor operation of the service caused by the seller or force majeure.
10. Modification of the TCS
10.1. The current TCS apply from 5th February 2018.
10.2. J. Preston reserves the right to totally or partially change the TCS.
10.3. Sellers are invited to regularly consult the TGS and make themselves aware of the changed content.
11. Miscellaneous Provisions
11.1. If any part of the TCS has been found to be illegal, invalid or inapplicable for whatever reason, the provisions will be deemed to have not been written without invalidating the other provisions which continue to apply between the Seller and J. Preston, except if it is a clause which has caused one of the parties to purchase a payable service.
11.2. All claims and grievances should be addressed to iVendre using the Contact Us link on the Internet Site.
11.3. The TCS are subject to French law.
